Terms of service

1. About these terms
These terms are an agreement between the business that uses Wizeply ("you") and WEBSMITH (Ran Koli), Israel, who operates Wizeply ("we"). By opening an account or using the service you accept them. You must be at least 18 and authorised to act for the business. Wizeply is a service for businesses, not for personal or household use.
2. The service
- Wizeply lets you set up automations that send and receive WhatsApp messages with your customers through the official WhatsApp Business Platform, and, if you connect them, act on leads from Meta Lead Ads forms.
- An AI setup assistant helps you build each automation. You review and approve an automation before it goes live.
- The service runs on Meta's platforms. Meta may reject or reclassify message templates, limit how many messages you can send, or restrict or suspend your WhatsApp Business Account or phone number. These decisions are Meta's, not ours.
- We may change, add or remove features. We will tell you in advance of a change that materially reduces the service.
3. Your account
- Give us accurate details and keep them up to date.
- Keep your sign-in details secure. You are responsible for what is done through your account.
- You keep ownership of your WhatsApp Business Account, your phone number and your Facebook Page. They are connected to Wizeply with your authorisation, and you can ask us to disconnect them at any time.
4. WhatsApp and Meta rules
You must follow the terms and policies that apply to your use of Meta's platforms, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and, if you use Lead Ads, Meta's terms for lead ads. If Meta restricts your account because of how you used it, that is your responsibility.
5. Consent: you are the sender
- You are the sender of every message your automations send, and the advertiser for the purposes of section 30A of Israel's Communications Law (Telecommunications and Broadcasting), 1982. You are responsible for having each customer's consent where the law or WhatsApp's policies require it.
- By connecting a source of contacts to your account (for example a lead form), or asking us to connect it, you confirm that you have obtained the consent it needs. We keep a record of that confirmation.
- Collect consent where the customer already is: your form, your checkout, your shop. Never send a WhatsApp message asking a person to opt in.
- Meta assigns each message template a category, such as marketing or utility, and Meta's category is the one that counts. Wizeply sends a marketing template outside an open conversation only to a contact with a recorded marketing consent, and stops messaging a contact who has opted out. These safeguards help you; they do not replace your duties.
- Keep your own records of how you obtained consent. Our records show only what reached Wizeply.
- Honour every opt-out, and do not message that person again unless they give consent again.
6. Acceptable use
You may not use Wizeply to:
- send unsolicited bulk messages, or message people from bought, rented or scraped lists;
- send unlawful, misleading, abusive or discriminatory content, or offer goods or services WhatsApp prohibits;
- impersonate another person or business;
- collect sensitive information, such as health or payment card details, that your automation does not need;
- get around WhatsApp's or Meta's limits, or our own;
- interfere with the service or its security, or copy or reverse-engineer it.
7. Your content and your customers' data
- Your messages, settings and customer data stay yours. You allow us to use them only to provide the service to you.
- For your customers' personal data, you decide how it is used and we process it on your behalf, as described in the privacy policy.
- You are responsible for the content of the messages you approve, including text the AI assistant drafted. The assistant can make mistakes: read what it proposes before you approve it.
8. Availability
We work to keep Wizeply running and reliable, but we do not guarantee that it will be uninterrupted or free of errors. The service is provided "as is" and "as available".
9. Liability
- To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, revenue or data, or for actions Meta takes on your accounts.
- To the extent the law allows, our total liability for any claim about the service is limited to the amount you paid us for the service in the 12 months before the claim.
- You will compensate us for claims and costs caused by messages you sent, by missing consent, or by your breach of these terms.
- Nothing in these terms limits liability that cannot be limited by law.
10. Suspension and ending
- You can stop using Wizeply and close your account at any time.
- We may suspend or close an account that breaches these terms, puts a WhatsApp account or other users at risk, or where the law requires it. Where we reasonably can, we will tell you first.
- When an account closes, we delete its data as described on the data deletion page.
11. Changes to these terms
We will post changes on this page with a new date. If a change is material, we will email account holders before it takes effect.
12. Law and courts
These terms are governed by the laws of the State of Israel. The competent courts in Israel have exclusive jurisdiction.
